A BILL for an Act to create and enact subdivision z of subsection 2 of section 28-32-01 and chapter 54-67 of the North Dakota Century Code, relating to the commission on guardianship; to amend and reenact subsection 1 of section 50-24.1-07 of the North Dakota Century Code, relating to the commission on guardianship and exempt administrative agencies; to provide a penalty; to provide for a legislative management report; and to provide a continuing appropriation.

  • Create a commission on guardianship under NDCC 28-32-01 (2) (z)
    • Add section to NDCC 54-67
    • Develop and Monitor all state funded guardianship services
    • Establishes membership, terms & appointment criteria of the commission
    • Establishes Commission Responsibilities
  • Provide Personal Identification protections to those receiving guardianship services
  • Establishes standards of guardianship services
    • Comply with NDCC 30.1-28
    • Minimum experience, training, qualifications for guardians
    • Case load standards, conflicts of interest, evaluation and ratio of guardianships
    • Reimbursement, efficiency and other standards as appropriate
  • Create a Commission Director
  • Create a Guardianship fund with continuing appropriation
  • Accept funds for programs
